What does the law require from employers?

For 2025, employers are encouraged to provide employees a summary of qualified overtime and qualified tips to help them determine eligibility for the new deduction. For 2026 through 2028, these amounts must be reported using designated codes on employee W-2 forms, as mandated by federal law.
